Preview websites we build are proposals owned by PBM Agency until purchased. Requesting or receiving a preview creates no obligation for you or us. Pricing shown on this site is current but may change; the price confirmed at purchase governs.

Intellectual property

The content of this site is owned by or licensed to PBM Agency and may not be reproduced without permission. On purchase of a website, ownership terms are confirmed in writing as part of the engagement.

Disclaimer and limitation of liability

This website is provided "as is" without warranties of any kind. To the fullest extent permitted by law, PBM Agency is not liable for damages arising from use of this website. Nothing in these terms limits liability that cannot be limited under applicable law.

SMS / text messaging program

Program.These are the terms of the PBM Agency SMS messaging program (the "Program"), operated by PBM Agency, LLC. By providing your mobile number in the optional phone field on our website contact form and checking the SMS consent box, by replying to a text from us, or by agreeing in writing to receive texts as part of our services, you consent to receive text messages from PBM Agency at the number you provide.

Message types. The Program sends updates about the website we built or are building for you, account and onboarding messages, replies to your questions, and occasional offers. Consent to receive text messages is not a condition of any purchase.

Message frequency and cost. Message frequency varies. Message and data rates may apply — contact your wireless provider for details about your plan. Carriers are not liable for delayed or undelivered messages.

Opt out and help. Reply STOP to unsubscribe (or cancel) at any time, after which you will receive one final confirmation and no further texts. Reply HELP for help, or contact us at hello@pbmagency.com or (512) 580-8472.

Privacy. See our Privacy Policy for how we handle mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

We may update these terms; the date above shows the last revision. Continued use after changes means you accept the updated terms.

Purchases and service agreement

If you purchase a website from PBM Agency, that engagement is governed by our Website Design & Care Services Agreement and Refund & Cancellation Policy, which set out ownership, domains, delivery, and refunds. Those documents, together with this page and our Privacy Policy, are the whole agreement between us.

Dispute resolution and arbitration

Before starting any formal proceeding, you agree to contact us at hello@pbmagency.com and give us 30 days to resolve the issue. Any dispute arising out of or relating to these terms or our services that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its rules for consumer or commercial disputes, seated in the county of PBM's principal place of business in the State of Texas. Either of us may instead bring an individual claim in small claims court if it qualifies.

Class action waiver. Disputes will be brought only in an individual capacity. Neither of us will bring or participate in a class, collective, consolidated, or representative action. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies. You may opt out of this arbitration section by emailing hello@pbmagency.com within 30 days of first accepting these terms.

Governing law

These terms are governed by the laws of the State of Texas.
